PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE.

All users of this site agree that access to and the use of this site is subject to the following terms and conditions. If you do not agree to these terms and conditions, please do not use this site.

TERMS AND CONDITIONS

This agreement is a contract between you (the 'customer') and Howard Park Wines Pty Ltd 11062755391 trading as Family Wines Direct.

Howard Park Wines Pty Ltd operates under the West Australian Liquor License numbers: Margaret River: 6180053900 and Denmark: 6180033365, owns the website www.familywinesdirect.com.au and is the supplier of wines via the website.  Our sales of imported Champagnes are approved under Wholesaler Licence number: 6160139601 (Howard Park Wines Pty Ltd, 2 Birksgate Road North Fremantle: +618 9336 9600).

All orders are processed and distributed by Howard Park Wines Pty Ltd. Our offers are transmitted from our licensed premises at 543 Miamup Road Cowaramup, WA 6284. 

Persons under 18 years of age are not permitted to place orders for alcohol.

www.familywinesdirect.com.au supports the responsible service of alcohol, and encourages moderation with regard to the consumption of alcohol.

The terms and conditions under which you may purchase products from www.familywinesdirect.com.au are set out below. Please read the following terms and conditions carefully before placing your order with Family Wines Direct.

By completing the customer application process and using the website service, you acknowledge that you have read and understood these terms and conditions and agree to be bound by the terms and conditions of this agreement.

PURCHASE ORDERS & DELIVERY OF GOODS

Delivery Area

Family Wines Direct provides delivery of goods across Australia. Family Wines Direct does not currently ship internationally.

Orders:

To place an Order with Family Wines Direct:

(a) Selecting Goods on the Family Wines Direct website, entering your Personal Details and pressing the "add to cart" and 'process order' button; or

(b) Selecting Goods and instructing Family Wines Direct by telephone that you wish to purchase the Goods, and providing your Personal Details to Family Wines Direct; or

(c) Selecting Goods and instructing Family Wines Direct by facsimile that you wish to purchase the Goods, and providing your Personal Details to Family Wines Direct; or

(d) Selecting Goods and instructing Family Wines Direct by e-mail that you wish to purchase the Goods, and providing your Personal Details to Family Wines Direct; or

Authorised Receipt of Goods

Anyone at the Delivery Address who receives the Goods shall be presumed by Family Wines Direct to be authorised to receive the Goods on your behalf. Australia Post will not accept signature for delivery of alcohol from anyone under 18 years of age.

Under law, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By placing an order, the buyer confirms they are at least 18 years of age. If buying wine as a gift, the recipient must also be at least 18 years of age.

RISK AND TITLE

Upon delivery of the goods to the customer's chosen address, the risk and title of the goods passes to the customer.

Returns and Refunds

If you are not satisfied with the quality of the goods you have received from Family Wines Direct contact us on (08) 9756 5200 or through our contact us page, preferably within two weeks of receipt of goods.

Returns: Where wine is to be returned Family Wines Direct will arrange to collect the wine from the buyer at a mutually convenient time. The buyer must keep the wine in a safe and proper manner and take reasonable care of it, wine should be returned in its original packaging or packed to avoid breakage during transport back to Family Wines Direct.

Refunds: If a refund of product is deemed appropriate, Family Wines Direct will affect the refund within 3 days of return of product to the winery.

PRICE OF GOODS & PAYMENT

Price of Goods:

The price the customer will pay for goods ordered will be the price specified on the product list plus delivery fees to ship the goods to the specified destination. All prices quoted are in Australian Dollars and include GST. Price variations do occur, the price paid will be the price quoted on the date of order.

Method of Payment:

Family Wines Direct accepts payment by MasterCard, Visa and American Express.  We can also accept Diners Club for telephone or email orders Payment must be received in full prior to goods being dispatched.

INTELLECTUAL PROPERTY

The material displayed on www.familywinesdirect.com.au is subject to copyright owned by Howard Park Wines Pty Ltd trading as Family Wines Direct and is protected by law. Website visitors must not do anything to prejudice the rights of the logo or graphics associated with the Family Wines Direct brand.

Copyright: All content included on this site, including but not limited to text, graphics, logos, button icons, images and software is the property of Howard Park Wines Pty Ltd trading as Family Wines Direct is protected by the Commonwealth of Australia Copyright Act 1968 and other international copyright laws.

Permission is granted to display and download or print portions of the material from the site solely for your own non-commercial use or to place an order with Family Wines Direct.

Any improper use, including but not limited to the reproduction, modification, distribution, transmission, re-publication or display of the content on this site is strictly prohibited.

Family Wines Direct encourages customer feedback. Family Wines Direct may block or delete material posted on the website if it is deemed abusive, defamatory, obscene or contrary to the law or the rights of any party.

SECURITY

If you (the customer) are issued with password by Family Wines Direct you agree to take responsibility for the safekeeping of your password. If any unauthorised person uses your password you are liable for their use and you agree to release and forever indemnify Family Wines Direct in relation to any liability howsoever arising out of the unauthorised use of your password.

NOTIFICATION OF CHANGES

Family Wines Direct may add to, delete, or otherwise change any of the terms of this Agreement without notice. In case of a modification, the pre-existing terms and conditions continue to apply to any products ordered via the website before the change takes effect.

PRIVACY AND SECURITY

Family Wines Direct has a clear privacy policy which also contains details regarding the security of your personal information.

PROMOTIONS

Family Wines Direct may offer specials, promotions and discounts on www.familywinesdirect.com.au. These promotions are available only while stocks last unless otherwise advertised and are subject to change without notice.

BUNKER BAY ACCOMMODATION VOUCHER T+C’s

1. The Family Wines Direct Pullman Bunker Bay Resort Promotion includes one night accommodation at the Pullman Bunker Bay Resort in a Garden View Studio Villa with Full Buffet Breakfast for two guests only.
2. All other expenses including travel to the resort are at the winner’s expense.
3. The voucher is valid to 30/01/2017
4. Family Wines Direct members can enter the competition as many times as they wish during the promotional period 21 September to 31 October 2016.
5. To enter the competition simply make a purchase online via the Family Wines Direct website www.familywinesdirect.com.au. Purchasing one case of wine equals one entry etc.
6. Bookings and Conditions as specified by Pullman Resort are:
- Bookings are subject to availability
- Black out dates apply, including public holidays and special events
- The certificate number must be quoted at the time of booking and presented to the front desk upon check-in.
- Certificate may not be redeemed for cash.
- No credit or change will be given on the unused portion of the certificate
- The certificate is not replaceable if lost, stolen or destroyed so keep it somewhere safe.
- Certificates that have been photocopied or altered in any way will not be accepted.
